Terms of Service

These Terms of Service (“Terms”) form a legally binding agreement between you and [KonKan operating entity — replace with legal name] (“KonKan”, “we”, “us”) and govern your access to and use of the KonKan mobile applications, the web application at konkan.krd, and any related services (together, the “Service”).

By creating an account, signing in, making a purchase, or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 13 years old to use the Service, or the higher age required by the laws of your country (16 in jurisdictions where the General Data Protection Regulation applies, unless a lower age is permitted by member-state law). If you are below the age of majority where you live, you confirm that a parent or legal guardian has reviewed and accepted these Terms on your behalf.

You are responsible for keeping your username, password, and any linked sign-in methods (such as Google or Apple) secure. Notify us immediately at [email protected] if you suspect unauthorised access.

You may not transfer, sell, lease, or share your account. We may refuse, suspend, or terminate accounts that violate these Terms.

You agree not to:

• Cheat, exploit bugs, use macros, bots, or any unauthorised third-party software or hardware that interacts with the Service.
• Collude with other players to influence game outcomes, ladder placement, or tournaments.
• Buy, sell, or transfer accounts, items, gems, or in-game advantages outside the Service.
• Use the Service to harass, abuse, threaten, impersonate, or defraud another person.
• Post content that is illegal, hateful, sexually explicit, or that promotes self-harm or violence.
• Attempt to access another user's account, probe our security, or interfere with the operation of the Service.
• Reverse-engineer, decompile, or extract source code from the Service, except to the extent expressly permitted by law.
• Use the Service in a way that violates any applicable law or regulation.

We may, at our discretion, remove content, restrict features, suspend or terminate accounts, and forfeit related gems or items where these rules are broken.

The Service uses an in-game currency called “gems” and offers virtual items (such as tile, table, rack, card-back, and avatar skins) and bundles. By purchasing or receiving gems or virtual items, you acquire a personal, non-exclusive, non-transferable, revocable licence to access them within the Service. You do not acquire any ownership interest in them.

Gems and virtual items:

• Have no monetary value, are not redeemable for cash, and cannot be exchanged outside the Service.
• Are non-transferable between accounts.
• Have no guaranteed availability and may be added, modified, repriced, discontinued, or removed at our discretion.
• Expire when your account is closed, whether by you or by us.

Prices displayed in the Service include applicable VAT/sales tax where required by law, unless stated otherwise at checkout.

Web purchases are processed by Stripe and, where supported in your region, by local payment processors such as FIB or Zain Cash. In-app purchases on iOS and Android are processed by Apple and Google respectively under their own terms. We never see or store your card details.

By making a purchase you authorise the relevant processor to charge your payment method for the amount displayed at checkout, plus any applicable taxes.

If a payment fails, is reversed, or is the subject of a chargeback that we did not authorise, we may suspend access to the related gems or items and your account until the matter is resolved.

Once gems or virtual items have been delivered to your account, all purchases are final and non-refundable except where required by applicable consumer-protection law. We may, at our sole discretion, grant a goodwill refund within fourteen (14) days of purchase — please write to [email protected] rather than initiate a chargeback. Chargebacks initiated without contacting us first may result in account suspension.

For purchases made through Apple or Google, refunds must be requested directly from the relevant store under their respective refund policies.

Where you are a consumer in the European Union or United Kingdom, you acknowledge that digital content delivered immediately is exempt from the statutory right of withdrawal once delivery has begun, in accordance with applicable law.

KonKan includes live and private chat features. Messages may be reviewed by automated systems and human moderators for safety, anti-abuse, and legal-compliance purposes. We may remove messages, temporarily mute, or permanently restrict chat features where these Terms are broken.

Players may also report each other and submit feedback. We act on reports at our discretion, applying penalties up to and including permanent account closure.

We make reasonable efforts to keep the Service available but do not warrant uninterrupted, error-free, or secure operation. We may modify, suspend, or discontinue any feature, region, or the entire Service at any time, with or without notice, including for maintenance, security, legal, or commercial reasons.

If we discontinue the Service entirely, we will give reasonable notice and, where practical, attempt to provide a way for paying users to redeem unused gems for items or content before shutdown.

KonKan, including its software, gameplay, art, sounds, fonts, trade marks, and documentation, is owned by us or our licensors and is protected by intellectual-property laws. Except for the limited licence to use the Service granted in these Terms, no rights are granted to you.

You retain ownership of content you submit (such as your avatar, username, and chat messages). By submitting it, you grant us a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, reproduce, modify (for technical purposes), publish, and display it to operate and improve the Service.

You represent that you have the rights necessary to grant this licence and that your content does not violate any law or third-party right.

You may stop using the Service at any time and may request account deletion at [email protected]. We may suspend or terminate your account, with or without notice, if you breach these Terms or if continued provision of the Service to you would expose us to legal or operational risk.

On termination, the licence to use the Service ends; unused gems and items are forfeited and are not refundable except as required by law. Sections that by their nature should survive (including ownership, disclaimers, liability, and governing law) survive termination.

The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited by applicable law, including liability for death or personal injury caused by negligence or for fraud.

To the maximum extent permitted by law, KonKan, its affiliates, officers, employees, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising out of or in connection with your use of the Service.

Our total aggregate liability arising out of or in connection with these Terms or the Service is limited, to the maximum extent permitted by law, to the greater of (i) the total amount you have paid to us for the Service in the twelve (12) months immediately preceding the event giving rise to the claim, and (ii) US $100.

You agree to defend, indemnify, and hold harmless KonKan, its affiliates, officers, employees, and licensors from and against any claims, damages, liabilities, and reasonable expenses (including legal fees) arising out of (i) your use of the Service in breach of these Terms, (ii) content you submit, or (iii) your violation of any law or third-party right.

These Terms are governed by the laws of [insert governing-law jurisdiction — typically the country where the KonKan operating entity is registered], without regard to its conflict-of-laws rules. The courts of that jurisdiction have exclusive jurisdiction over any dispute, subject to your mandatory consumer-protection rights in your country of residence.

Before bringing any formal dispute, please write to [email protected]. We will try in good faith to resolve the matter informally within thirty (30) days.

We may update these Terms from time to time. When we make material changes, we will notify you in the Service, by email if we have one on file, or by posting a prominent notice on konkan.krd. The “Effective” date above will be updated. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not accept the updated Terms, you must stop using the Service.

Entire agreement. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service.

Severability. If any provision is held unenforceable, the remainder will continue in effect.

No waiver. Our failure to enforce a provision is not a waiver of our right to do so later.

Assignment. You may not assign these Terms without our prior written consent. We may assign them, in whole or in part, to an affiliate or in connection with a merger, acquisition, or sale of assets.

Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.

Notices. We may give you notices through the Service, by email, or by posting on konkan.krd. You give us notice by writing to [email protected].
